GENERAL TERMS AND CONDITIONS OF USE and/or RENTAL OF THE BNBHERE PLATFORM

Glossary

The terms “Bnbhere,” “agent,” “we,” “our,” or “us” used in these Terms refer to the company BNB REAL ESTATE SAS.
The “platform” or the “site” refers to the Bnbhere matchmaking platform.
T&Cs (CGU): General Terms and Conditions of Use.
Owner: A member of the Bnbhere Site who has published a listing in order to offer their property for seasonal rental. This action may be carried out through a legal agent.
Traveler: A person who wishes to or has booked a property from an Owner through the Bnbhere platform.
User: Any person who accesses the platform.
Villa: A house or apartment available for seasonal rental through Bnbhere.

Please read these General Terms and Conditions of Use carefully as they contain important information regarding your rights, obligations, and legal remedies.

Access to and use of the Bnbhere Platform are subject to acceptance of these General Terms and Conditions of Use.
By accessing or using the Bnbhere Platform, you agree to be bound by and comply with these Terms and Conditions.

These General Terms and Conditions of Use constitute a legally binding agreement between you and Bnbhere (as defined below) and govern your access to and use of the platform, including other sites offered through the Bnbhere Platform.

This Agreement shall be valid for a period of 30 days, after which it will be automatically and permanently renewed for successive 30-day periods until you request termination by registered letter sent to the registered office of Bnbhere.

Users are advised to refer to the latest version of the T&Cs, accessible at any time on the site, before browsing. If you disagree with the terms and conditions, you may not use the site.

The publisher reserves the right to modify the site and its services, as well as these T&Cs, at any time and without notice, particularly in order to comply with regulatory, legal, editorial, and/or technical developments.

For the proper information of Owners, within a reasonable period before the publication of new general terms and conditions, the Bnbhere platform will send each Owner an email informing them of the changes.
If the said terms are not contested within 10 days of receipt of the email, the new terms will be considered accepted.

For any questions or information requests regarding the site, or to report unlawful content or activities, the User may contact the publisher at: contact@bnbhere.com or send a registered letter with acknowledgment of receipt to the company’s registered office indicated above.

The manner in which we collect and use personal data in relation to your access to and use of the Bnbhere Platform is described in the section on personal data protection.

All payment services related to your use of the Bnbhere Platform are provided by an independent company, STRIPE (www.stripe.com).The terms relating to payments via Stripe are accessible through the following link: https://stripe.com/payment-terms/legal 

These T&Cs also apply, where relevant, to any variation or extension of the Bnbhere website, including on current or future social and/or community networks.


1. Services offered by the Bnbhere Platform

1.1
The Bnbhere Platform is an online marketplace that allows registered users, with or without an agent (“Owners”), to publish a seasonal rental listing of a property (“Villas”) located in mainland France.
The Bnbhere platform thus enables Owners of real estate to connect with Travelers seeking holiday accommodation. The platform allows Owners and Travelers to deal directly in order to conclude a seasonal rental agreement.
The Bnbhere platform does not present properties for sale or for long-term rental, whether furnished or unfurnished.

1.2
Bnbhere also offers a listing-writing assistance service.
This service can be accessed via the CONTACT tab after requesting registration with the Bnbhere Platform.
To request this service, various details must be provided (first name, last name, email address).

1.3
Bnbhere provides a concierge service, a complementary activity aimed at maximizing satisfaction for Owners and Travelers booking a property featured in the platform’s collection.
This concierge service is independent of the matchmaking activity and will be subject to a separate agreement.
The matchmaking and concierge services are independent.
The booking of a property by a Traveler or the publication of a listing by an Owner on the Bnbhere platform includes access to the concierge service.
The Bnbhere concierge service must be requested by interested parties via phone +33(0)9 51 21 07 12 or email contact@bnbhere.com.

1.4
Bnbhere does not own or create listings (except as part of the ad-writing assistance service), nor does it sell, resell, provide, control, or manage any properties.
Owners or their legal representatives are solely responsible for their listings.
When Owners make or accept a booking, they enter into a seasonal rental agreement directly with the Traveler. Bnbhere is not and does not become a party to any contract between Owners and Travelers.
Bnbhere acts as a villa manager on behalf of the Owners. Bnbhere’s role is that of intermediary and concierge service provider.

1.5
Bnbhere cannot be held responsible for the behavior of any Owners or Travelers.
Some listings may contain images featuring a Bnbhere logo.
This means that, at the time the photo was taken, the property actually matched the seasonal rental listing offered by the Owner, as Bnbhere had visited the property beforehand.
This does not constitute Bnbhere’s endorsement of any Owner or listing.
If the property has changed since the date the photo was taken, Bnbhere cannot be held liable.
The Owner remains solely responsible for their listing and the photos they publish.

1.6
To assist Owners or Travelers who speak another language, Listings and other types of Member Content may be translated, fully or partially, into other languages. Bnbhere cannot guarantee the accuracy or quality of such translations, and it is the Owner’s responsibility to verify their accuracy.
Since translations are intended to give Owners greater visibility on the Platform, Bnbhere does not need to seek the Owner’s permission to translate their listing.
If you do not wish your listing to be translated, you must inform Bnbhere by email or by registered letter sent to the registered office.

2. Eligibility

2.1
You must be at least 18 years old (or the legal age required in your country of residence) and have the legal capacity to enter into contracts in order to access and use the Bnbhere Platform for the purpose of requesting the rental of a Villa from the Bnbhere collection.
By accessing or using the Platform, you certify that you are at least 18 years old and have the legal capacity and authority to enter into contracts. Furthermore, you warrant that all information you provide is true and accurate.

2.2
Bnbhere declines all responsibility with regard to the identity of Travelers.

2.3
Bnbhere.com is a matchmaking platform between Travelers and Owners of villas or apartments.
Bnbhere reserves the right to refuse the publication of any listings concerning a villa or apartment without having to provide justification to the Owner.


3. Access to the Bnbhere Platform

The Bnbhere Platform is available at: www.bnbhere.com
Connecting to and browsing the Bnbhere website implies unconditional acceptance of these Terms and Conditions of Use, regardless of the means of access or the devices used.

3.1 Reservation of Villas for Seasonal Rental by a Traveler:
Travelers wishing to book a property can visit the PROPERTY tab to view all listings published by Owners.
It is not necessary to create a Traveler account, but certain personal information must be provided in order to request the reservation of a Villa from the collection.

The Traveler is responsible for the accuracy of the information provided. Bnbhere cannot be held liable for incorrect or misleading information supplied by a Traveler when making a reservation.

Depending on the Owner’s choice, the reservation may be accepted instantly or subject to their prior approval.
The availability displayed at the bottom of the page is provided for information purposes only.

Bnbhere does not guarantee Travelers the availability shown until the reservation request has been accepted by the Owner and the Traveler has received a booking confirmation email.
Bnbhere cannot be held liable for the cancellation of a reservation after acceptance by the Owner or for the Owner’s refusal of a reservation.

The cancellation conditions (notice period, whether free or subject to fees) are specified by the Owner or their legal representative in the Villa’s listing. Each Owner or representative has their own cancellation policy.

To book a property through the Platform, the Traveler must specify the number of people who will occupy the property. The information provided must be truthful.

It is strictly forbidden for Travelers to occupy properties beyond the maximum capacity stated by the Owner in the listing. In case of non-compliance, the Owner and Bnbhere reserve the right to claim damages.

It is reiterated that the listing is created by the Owner or their representative, who remains solely responsible for the information provided.
Bnbhere cannot be held liable for any errors or inaccuracies concerning the characteristics of the rented property.


4. Responsibility of Owners

Owners are solely responsible for complying with all applicable laws, rules, and regulations regarding their listings and the seasonal rental activity.

For example, some cities have adopted laws prohibiting the paid accommodation of Travelers for short periods.
Each Owner must personally verify with the competent local authorities (city, municipality, etc.) whether declarations, authorizations, or other mandatory formalities are required to rent their property on a seasonal basis.

It is also reiterated that the preparation, distribution, or sale of food and alcoholic beverages is strictly regulated by law. Any Owner wishing to engage in such activities must contact the relevant authorities to obtain the necessary permits, or at least consult with legal counsel to understand their rights and obligations.

Bnbhere cannot be held liable for an Owner’s failure to comply with their legal obligations.


5. Owners’ Tax and Social Obligations

Bnbhere reminds all Owners of their tax and social obligations related to the seasonal rental of real estate.
Each Owner must provide a valid address.

Bnbhere also recommends that Owners seek legal advice to ensure they comply with all applicable local and national regulations concerning seasonal rentals.


6. Special Conditions for Owners

6.1 Conditions applicable to Listings

When an Owner (or their representative) publishes a Listing on the Bnbhere Platform, they must provide complete and accurate information. Bnbhere expects Owners to give a truthful description of the property. Availability dates must be updated regularly by the Owner.

Bnbhere reserves the right to request clarification from an Owner about their listing. If the Owner fails to provide clarification despite Bnbhere’s recommendations, Bnbhere reserves the right to delete or suspend the listing or the Owner’s account.

If Bnbhere has doubts about the accuracy of a listing, it may freely decide not to publish it. The Owner will be informed of the reasons and must comply with Bnbhere’s recommendations before the listing can be published. No claims may be made against Bnbhere in this respect.

Owners must keep their listing information up to date.
The Owner or their representative is solely responsible for setting the listing price (including applicable taxes). Once a Traveler has booked, no higher price may be requested than that indicated in the booking request.

The rental or cancellation terms specified in the Listing must not conflict with these Terms of Use and must comply with customary practice and applicable regulations.

When a reservation request from a Traveler is accepted or pre-approved, a legally binding seasonal rental contract is formed between the Owner and the Traveler. The Owner must provide the services described in the listing on the booked date.

Owners also agree to comply with national legislation regarding tax and social declarations.

Bnbhere recommends that each Owner take out adequate insurance for seasonal rentals. Owners are advised to review their insurance contracts and seek legal advice to ensure that the coverage and exclusions are appropriate for their activity.

6.2 Content of Listings

Each Listing must refer to a single accommodation.
If a security deposit is required, it must be mentioned in the rental contract (“Security Deposit” or “deposit”). Owners are prohibited from requesting a deposit after confirming a reservation, or outside of the Bnbhere Platform, beyond the amount stipulated. The deposit must be provided at the latest on the day of arrival (credit card pre-authorization at the agency, or check cashed at least 14 days before arrival).

Bnbhere is not responsible for managing or handling any claims relating to security deposits.

By offering a property for rent, the Owner warrants that the rental does not violate any agreements with third parties, condominium rules, or other contracts.
As a mandating Owner of BNB Real Estate, the Owner guarantees that the Listing complies with all applicable laws (such as zoning laws), tax obligations, and other rules and regulations (including obtaining required permits, licenses, and registrations).

If the property is located within a condominium, Owners are advised to verify whether seasonal rental is permitted by the condominium rules.

Concierge Service
A Bnbhere badge on a listing indicates that the Owner has subscribed to Bnbhere’s concierge services.

Having a concierge service does not improve the visibility of the villa within the Bnbhere collection.


7. Special Conditions for Travelers

7.1 Conditions applicable to all Reservations

Subject to compliance with the Owner’s conditions, you may book a property listed on the Bnbhere Platform by following the appropriate booking procedure after selecting a Villa from the Bnbhere collection and providing the required information.

A summary of the various costs and fees (rental price, deposit, VAT, etc.) is displayed during the booking process.
No additional fees for the same service will be requested after the reservation has been accepted by the Owner.

By requesting the reservation of a villa, you agree to pay the amounts indicated in the listing and rental contract. Payment conditions are described below.

Upon receipt of a booking confirmation from Bnbhere, a legally binding seasonal rental agreement is formed, subject to the cancellation conditions specified in the listing or to legally permissible cancellation grounds (force majeure, etc.).

Payment is processed via Stripe, unless payment is made at the agency. By making payment, you accept Stripe’s general terms and conditions: https://stripe.com/fr/legal
If Stripe is not used, the payment platform Smily / SmilyPay / Central Pay will be used.

As a Traveler, you agree that other Travelers occupying the Villa with you will comply with these Terms and the conditions specified in the listing.

If you make a reservation on behalf of a minor, you represent and warrant that you are legally authorized to act on behalf of the minor.

7.2 Booking Accommodations

A confirmed reservation of a Villa constitutes a limited authorization granted to the Traveler by the Owner to enter, occupy, and enjoy the property for the agreed duration.

As a Traveler, you agree to vacate the property no later than the departure date and time specified in the Listing, unless otherwise agreed with the Owner.

If you remain beyond the specified checkout time without the Owner’s consent, you are no longer authorized to occupy the property and will be considered an unauthorized occupant.
In such a case, the Owner or their representative has the right to lawfully evict you.

Bnbhere also reserves the right to seek damages in court.

If you remain without authorization, you agree to pay, at the request of the Owner or Bnbhere, for each additional twenty-four (24) hours (full or partial) of stay, an occupancy fee equal to twice the nightly listed price.

You also agree to pay all applicable taxes and fees. Legal and ancillary expenses required for your eviction will also be at your expense.
All such costs, including unauthorized occupancy fees, may be deducted from the security deposit at the Owner’s request.


8. Service Fees

Bnbhere charges Owners a service fee for each reservation made through the Platform.
The total amount of the reservation must be paid through the Stripe payment gateway.

Service fees are included in the total rental amount shown to the Traveler during booking.
Through Stripe, the total reservation amount will be transferred to the Owner’s account.

Monthly or quarterly, the Bnbhere Platform will send the Owner an invoice corresponding to the service fees due for the period. The invoice is payable upon receipt.

The service fee amounts to 3% including taxes of the total reservation amount, including cleaning fees and any other possible charges.


9. Damages to Accommodations, Disputes between Users

As a Traveler, you must return the rented Villa (including all personal belongings and other property therein) in the condition in which you found it upon arrival. You are responsible for your own actions and omissions as well as those of anyone you invite into the Villa or any animals under your care.

If an Owner or their representative demonstrates that a Traveler caused damage to the Villa or its furnishings, the Owner may request reimbursement for the costs of repairs.

If an Owner submits a complaint to Bnbhere regarding damage to their property, the allegedly responsible Traveler will be notified by the Platform and may provide written information in response.

Travelers and Owners must cooperate to resolve such disputes amicably.

If a Traveler refuses to cover the repair costs, the Owner may take legal action to recover the said costs as well as any legal expenses incurred.

If it is established that the Traveler is responsible for the damages, Bnbhere may, at the Owner’s request, authorize Stripe to debit the amounts necessary for repair.

In the event of significant damages after a Traveler’s stay, Bnbhere recommends that the Owner have the damages recorded by a Bailiff (at the Owner’s expense) or at least provide photographic evidence.

Bnbhere is not authorized to pursue legal action, at its own expense, against Travelers who caused damage to a Villa or its furnishings. Only the Owner or their representative has standing to take legal action for payment of the claimed amounts.

Bnbhere reserves the right to sue the Traveler for damages to its own image.

If a Traveler is found responsible for damages, Bnbhere reserves the right to refuse any future bookings requested by that Traveler.

10. Responsibility of Bnbhere

10.1
The User is solely responsible for the choices he makes.

10.2
Bnbhere cannot be held responsible for direct or indirect damages, losses, or costs resulting from the use of the Site or the impossibility to use it, or for any malfunction, interruption due to maintenance, technical failure of the server, or related to the Internet network.

10.3
Bnbhere cannot be held responsible for the unavailability of the site, or for any virus that may appear on the Site.

10.4
Bnbhere cannot be held responsible in case of force majeure or unforeseeable and insurmountable act of a third party, as defined by French case law.


11. Intellectual Property

11.1
All texts, comments, works, illustrations, and images reproduced or represented on the Site are strictly reserved under copyright and intellectual property law, worldwide.

11.2
As such, and in accordance with the provisions of the French Intellectual Property Code, only private use is authorized, subject to different or stricter provisions of the Intellectual Property Code.

11.3
Any reproduction or representation, in whole or in part, of the Site or all or part of the elements found on the Site is strictly prohibited.


12. Data Protection and Privacy

12.1
In accordance with the French Data Protection Act of January 6, 1978, as amended, and with Regulation (EU) 2016/679 of April 27, 2016, the User is informed that Bnbhere, as data controller, processes personal data.

12.2
The data collected is necessary for managing reservations and for the proper functioning of the Platform.

12.3
The User has the right to access, rectify, delete, and port his data, as well as the right to restrict and object to processing.

For more information on how Bnbhere processes data, the User is invited to consult the Privacy Policy accessible on the Site.


13. Applicable Law and Jurisdiction

13.1
The present Terms and Conditions are governed by French law.

13.2
In case of dispute and failing an amicable agreement, the French courts shall have exclusive jurisdiction.

13.3
The User is informed that he may in any case resort to conventional mediation, in particular with the Commission de la Médiation de la Consommation (Consumer Mediation Commission) or with existing sectoral mediation bodies, or any alternative dispute resolution method (conciliation, for example) in the event of a dispute.


14. Miscellaneous

14.1
If one or more provisions of these Terms and Conditions are held to be invalid or declared as such under a law, regulation, or following a final decision of a competent court, the other provisions shall retain their full force and effect.

14.2
The fact that one of the Parties does not rely on a breach by the other Party of any of the obligations referred to in these Terms shall not be interpreted as a waiver of the obligation in question.

15. Access to the Site

15.1
Access to the Site is free for any User with Internet access. All costs related to access to the Site, whether hardware, software, or Internet access fees, are exclusively borne by the User.

15.2
The User is solely responsible for the proper functioning of his computer equipment as well as his Internet access.

15.3
The Site is accessible 24/7, except in cases of force majeure, possible breakdowns, or maintenance interventions necessary for its proper functioning.


16. Hyperlinks

16.1
The Site may contain hyperlinks directing the User to third-party sites.

16.2
Bnbhere cannot be held responsible for the content of these third-party sites.

16.3
The creation of hyperlinks to the Site is subject to the prior written authorization of Bnbhere.


17. Evidence

17.1
Computerized records stored in Bnbhere’s computer systems under reasonable security conditions shall be considered proof of communications, reservations, and payments between the Parties.

17.2
They are admissible as evidence under the same conditions and with the same probative value as any document that would be established, received, or kept in writing.


18. Duration

18.1
These Terms and Conditions apply for an indefinite period, starting from the use of the Site by the User.

18.2
The contract is concluded for a duration of thirty (30) days, automatically and permanently renewed for successive periods of thirty (30) days, unless terminated by registered mail addressed to Bnbhere’s registered office.


19. Termination

19.1
In the event of non-compliance with the obligations arising from acceptance of the Terms and Conditions, incidents of payment of the price of a reservation, the provision of incorrect information at the time of creating the account, or acts likely to harm the interests of Bnbhere, the Site, or third parties, Bnbhere reserves the right to suspend access to the services without notice or, depending on the seriousness of the acts, to terminate the account of the User without damages.

19.2
Bnbhere also reserves the right to refuse to contract with a User who has been excluded or sanctioned for such acts.


20. Notifications

20.1
Any notification or communication under these Terms and Conditions must be made in writing and sent by registered letter with acknowledgment of receipt to the addresses indicated in the preamble of the Terms, unless otherwise specified.


21. Language

21.1
These Terms and Conditions are written in French.

21.2
In case of translation into one or more languages, only the French text shall prevail in the event of dispute.


22. Mediation

22.1
In accordance with the provisions of the Consumer Code concerning the amicable settlement of disputes, Bnbhere adheres to the services of a consumer mediator.

22.2
In case of dispute, the User may first contact Bnbhere’s customer service by email at contact@bnbhere.com or by mail at the company’s registered office.

22.3
If no amicable agreement is reached, the User may refer the matter to the mediator free of charge.
